Terms and conditions of sale

The general terms and conditions of sale govern all sales concluded between SARL Cortigrimpe (also referred to as Cortigrimpe below) and any customer (also referred to as a member below) via the website corti-grimpe.fr or at the Cortigrimpe reception desk.

The general terms and conditions of sale in force on the date of the order take precedence over any conditions or stipulations to the contrary.

The placing of any order by the customer implies acceptance of the present terms and conditions of sale. The customer declares that he/she has read and accepted these terms and conditions of sale in their entirety.

Having familiarized themselves with the services and facilities on offer, members sign a contract with Cortigrimpe, authorizing them to use its facilities and benefit from the services offered by Cortigrimpe, within the limits of the service chosen and paid for on the cortigrimpe.fr website, or at the Cortigrimpe reception desk.

In addition to the services covered by the present contract, Cortigrimpe may offer activities for which the member will be billed directly by Cortigrimpe. The rates for these services will be posted at the reception desk and, where applicable, on our website.

The contract for access to the facilities is conditional on the purchase of a session, a subscription or a prepaid session card.

Prices for these services are displayed at reception and on the Cortigrimpe website, and are payable by credit card (within the limits of the cards accepted by the TPE), cheque, ANCV vacation and sports vouchers, cash, bank transfer or monthly direct debit.

For subscriptions and prepaid cards, members will be sold a personal, non-transferable Cortigrimpe smart badge on their first visit.

This pass may be refunded at the end of the contract, provided it is returned in good condition.

 Members must be in possession of this pass every time they visit the climbing gym.

 Members with a valid Cortigrimpe pass, or who have paid for their session, may enter the climbing gym and use the facilities within the framework of the opening hours and in compliance with the posted rules and regulations, of which they must be aware.

  • Article 3-1: Subscription

The effective date of the subscription corresponds to the contract subscription date. Subscriptions may be taken out for 3 months, 6 months or one year. In exceptional cases, a one-month subscription may be offered as a promotional offer. Subscription prices are displayed at reception and on our website.

The "happy hours" pass can only be used for limited periods at times specified at reception and on our website.

The end of the subscription marks the end of the contract. To continue receiving benefits, the member must sign a new contract.

  • Article 3-2: Prepaid session card

The effective date of the prepaid session card corresponds to the contract subscription date. The price of prepaid session cards is displayed at reception, and is also available on our website.

Prepaid "happy hours" session cards can only be used in limited slots at times specified at reception.

Each time the card is used, a session is counted.

Once all sessions have been used, the contract ends. To continue benefiting from the services, the member must take out a new contract.

  • Article 3-3: Unit session

The purchase of a single session corresponds to the subscription of a contract for a single access to the site.

 Prices for individual sessions are displayed at reception, and can also be found on our website.

Leaving the facilities marks the end of the contract. To continue to benefit from the services, the member must sign a new contract.

Climbing is a physical and sporting activity that can present risks. The member acknowledges that he/she is aware of the risks associated with the activity.

 The member declares that he/she has read and understood the rules and regulations posted at the reception desk, in particular those governing safety, hygiene and access to the climbing gym, and agrees to abide by them without restriction or reservation.

The member acknowledges that he/she has taken note of the timetables, which may be modified without prior notice in the following cases: organization of events or during periods deemed appropriate by Cortigrimpe (maintenance or work, for example) or in the event of force majeure. The customer will be informed of any such modifications by posting on the site, or by logging on to www.corti-grimpe.fr. These modifications cannot give rise to a refund. 

Temporary exclusion: anyone whose attitude, behavior or dress is contrary to good morals, or notoriously annoying to other members, or does not comply with the present contract or the Cortigrimpe climbing gym's internal rules, may be asked to leave the facility temporarily.

Permanent exclusion: The member acknowledges that the management has the right to exclude permanently from the establishment, by letter with acknowledgement of receipt, any person whose attitude, behavior or dress is contrary to good morals, or notoriously annoying to other members, or does not comply with this contract or the rules of the Cortigrimpe climbing gym.

In the event of exclusion, the member is not entitled to a refund.

 Outsiders invited by a member or for a trial session are subject to the same rules and conditions as members, and must register at reception before their session.

However, the contract may be suspended in the event of a temporary ban on physical activity (justified by a medical certificate presented within 7 days). The subscription will then be extended free of charge as soon as the activity is resumed.

In the event of breach of any contractual obligation, late or non-payment, or failure to comply with internal regulations, Cortigrimpe reserves the right to terminate the subscription unconditionally.

Cortigrimpe is insured for damage involving its civil liability, that of its staff and that of sports enthusiasts, in accordance with article L321-7 of the French Sports Code.

Members are invited to take out a personal insurance policy, covering them for any bodily injury they may suffer, and for their own civil liability, covering any damage they may cause to third parties. 

 In accordance with the French Data Protection Act of January 6, 1978, members have the right to access, rectify and object to data in their file, by sending a simple request by e-mail to contact@corti-grimpe.fr. In addition, members must inform Cortigrimpe of any change in their situation [CB6]. 

 The user undertakes to notify Cortigrimpe immediately of the loss or theft of his subscription badge by telephone or by any other means of his choice (letter, e-mail).

At the same time, Cortigrimpe will pause the subscription.  

In the event of a case of force majeure characterized by its unforeseeability, irresistibility, and making the proper performance of the contract temporarily or permanently impossible, the parties agree to make every effort to find an amicable solution for the continuation of the contract. Should performance prove impossible, the contract may be terminated ipso jure.

The above provisions are governed by French law.

Any and all disputes arising out of or in connection with the validity, interpretation, performance, consequences and consequences of the present terms and conditions shall be submitted to the competent courts under the conditions of ordinary law.
